Affiliate partners agreement

Effective Date: January 1, 2025

This Affiliate Partner Agreement ("Agreement") sets forth the terms and conditions between you ("Affiliate") and THE s.r.o., Brněnská Pole 1876/18, 664 51 Šlapanice, Czech Republic, VAT: CZ06626084 (“Company”), regarding participation in the LEVA Affiliate and Influencer Partnership Program (“Program”).

By joining the Program, you agree to be bound by the terms of this Agreement.

1. Program Overview

As an Affiliate, you are authorized to promote and refer customers to our online platform offering digital home design projects and related BIM content.

Affiliates can promote through:

  • Unique affiliate links
  • Custom discount promo codes (up to 15% off for your audience, available to approved influencers)

In return, Affiliates receive commission-based compensation according to the program tier and sales performance described below.

2. Commission Structure

All commissions are managed through the UpPromote technology and calculated automatically based on verified sales.

Affiliate Commission Rules

  • Cookie duration: 21 days
  • Commission type: Percent of sale
  • Base commission: 35% on eligible project sales
  • Bonus: +15% for affiliates with total sales exceeding $10,000
  • Payments: Processed monthly via PayPal or bank transfer within the first week of each month
  • Approval: Manual review for all new affiliates

All commissions are calculated from the discounted price (after the promo code is applied).
Example: If a product costs €100 and a 15% discount is used, commission is based on €85.

Payouts are made monthly via bank transfer or PayPal, once the total earned commission reaches a minimum of €50. Balances below this threshold roll over to the next month.

Affiliates are responsible for all tax and legal obligations in their country of residence.

3. Influencer Program Tiers

Tier 1 — “Reward Your Fans”

Minimum 100,000 followers

  • The Affiliate receives a unique promo code worth $100, which their followers can use to claim any LEVA project up to that value (most projects will be available completely free).

  • Each follower can use the code once only.

  • Affiliates promote LEVA using a referral link directing users to WhatsApp with a pre-filled claim message.

  • This tier is focused on brand awareness and engagement; it does not generate commission.

Tier 2 — “Build & Share”

Minimum 500,000 followers

  • The Affiliate receives a custom LEVA project (house, pool, or garden structure) created according to their materials and preferences.

  • The Affiliate agrees to document the project (photos, videos, and updates) and share the content publicly on social media.

  • The Affiliate provides feedback on time consumption and practical execution details for inclusion in the shared BOQ.

  • To qualify for this tier, the Affiliate must first generate at least 20 project sales through their referral link. LEVA reserves the right to waive this requirement based on the attractiveness of the influencer and the project concept.

  • Commission:

    • 50% for project sales made through the Affiliate’s link
    • 25% for platform sales without the link

Tier 3 — “Create & Earn”

Minimum 1,000,000 followers

  • LEVA develops a signature project reflecting the Affiliate’s vision, style, or personal branding.

  • The Affiliate promotes this project across their channels.

  • The Affiliate is not required to construct the project personally.

  • To qualify for this tier, the Affiliate must first generate at least 50 project sales through their referral link. LEVA reserves the right to waive this requirement based on the influencer’s reach and project potential.

  • Commission:

    • 40% for project sales made through the Affiliate’s link
    • 20% for platform sales without the link

4. Pricing and Marketing Rights

  • All product prices are set solely by LEVA and may change over time based on business needs, expansion, or marketing strategy.
  • The Company reserves the right to conduct special marketing campaigns (such as Black Friday promotions) where additional discounts may apply.
  • Commissions are always calculated from the final sale price after all applicable discounts.

5. Prohibited Activities

The following actions are strictly prohibited:

  • Sending unsolicited messages or emails (spam)
  • Misleading, deceptive, or false advertising
  • Creating fake accounts or generating artificial traffic
  • Running paid advertisements using LEVA trademarks without written approval

Violation may result in immediate termination and forfeiture of unpaid commissions.

6. Term and Termination

This Agreement remains effective until terminated by either party, at any time and for any reason.

Upon termination:

  • Approved commissions for sales made before termination will be paid.
  • Issued promo codes remain valid for 30 days after first use.

Affiliate performance is reviewed every 30 days to ensure ongoing alignment with program objectives.

7. Dashboard Access

Affiliates have access to the UpPromote dashboard, which provides:

  • Real-time tracking of clicks, referrals, and sales
  • Commission and payout summaries
  • Conversion statistics and performance analytics

8. Intellectual Property

  • All designs, models, visuals, and related digital assets remain the exclusive property of LEVA.
  • Affiliates in Tiers 2 and 3 grant LEVA a non-exclusive, royalty-free, worldwide license to use shared content (images, videos, or posts) for marketing purposes.
  • Signature Projects remain LEVA’s intellectual property, with appropriate attribution to the Affiliate.
