OVERVIEW

Welcome to LEVA. The terms "we", "us" and "our" refer to THE s.r.o., Brnenska Pole 1876/18, 664 51 Slapanice, Czech Republic, VAT: CZ06626084 ("LEVA").

LEVA operates this website and online store, including all related information, content, features, tools, digital products, and services (collectively, the "Services"). LEVA is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms"), together with any policies referenced herein, govern your access to and use of the Services. Please read them carefully, as they include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, accessing, or using the Services, including by purchasing any products, publishing or importing a shared budget, requesting prices from another user, or submitting a quote to another user, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

SECTION 1 - ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your jurisdiction and legally capable of entering into binding agreements.

To access certain Services or purchase products, you may be required to provide information including your email address and billing details. You represent and warrant that all information you provide is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

LEVA provides digital Building Information Modeling (BIM) products, including but not limited to:

  • Architectural and construction designs
  • DWG / PDF drawings
  • IFC and other 3D models
  • Technical and manufacturing datasheets
  • Construction assemblies and systems

All products are delivered digitally via customer accounts. No physical goods are supplied.

We make reasonable efforts to accurately describe our products; however, visual representations, previews, and renders are illustrative only and may differ from the final delivered files. Product descriptions may be updated or modified at any time without notice.

SECTION 3 - ORDERS

By placing an order, you submit an offer to purchase a digital product. LEVA reserves the right to accept or reject any order at its discretion.

An order is considered accepted only after payment has been successfully processed. Due to the digital nature of the products, orders generally cannot be cancelled once accepted.

Refunds, if any, are governed exclusively by our Refund Policy and applicable consumer protection laws.

SECTION 3A - CUSTOM CONFIGURATOR PROJECTS

Certain digital products offered through the Services may be generated or prepared individually based on specifications, selections, dimensions, layouts, options, or other parameters submitted by the customer through LEVA's online configurator ("Custom Projects").

By placing an order for a Custom Project, you acknowledge and agree that the final delivered documentation, files, models, drawings, estimates, and related outputs will be created strictly in accordance with the configuration data submitted at the time of purchase. It is the customer's sole responsibility to verify all selected parameters, dimensions, options, and requested features before completing the order.

Unless expressly stated otherwise in writing, Custom Projects are delivered as a final one-time customized digital product and do not include post-delivery revisions, redesigns, consultations, modifications, or iterative development rounds.

Any requested changes after order placement or after delivery, including corrections resulting from customer-entered data, altered preferences, new requirements, or additional scope, may require submission of a new order and payment of applicable fees.

LEVA strongly recommends that customers review available free sample products, previews, example documentation, specifications, and other informational materials made available through the Services prior to purchasing a Custom Project, in order to understand the nature, scope, format, and expected contents of the deliverables.

Due to their personalized and made-to-order nature, Custom Projects may be subject to separate refund limitations to the maximum extent permitted by applicable law.

SECTION 4 - PRICES AND PAYMENT

All prices are displayed in the applicable currency and include or exclude VAT as specified. Prices may change at any time without prior notice.

Payments are processed securely via Shopify-supported payment gateways. You represent and warrant that you are authorized to use the payment method provided and that all payment information is accurate.

This Section governs only products sold by LEVA. Prices, rates, quantities, and totals exchanged between users through the Budgeting Tool, Shared Budgets, Price Requests, or Quotes are not prices charged by LEVA, are not offers made by LEVA, and are governed by Sections 5A and 5B.

SECTION 5 - PRODUCT USE, VALIDATION AND LIMITATIONS

All projects, drawings, BIM models, and related documentation provided by LEVA are pre-dimensioned, generalized, and informational in nature. They are not site-specific execution documents.

Before any construction, fabrication, permitting, or execution, all documentation must be reviewed, adapted, validated, and approved by locally authorized professionals, including but not limited to:

  • a licensed architect or project designer,
  • a licensed structural engineer,
  • and any other required local technical authority or supervisor,

in accordance with applicable local laws, building codes, standards, and permitting requirements.

LEVA does not provide site-specific engineering, statutory approvals, local permits, or final execution documentation and assumes no responsibility for construction outcomes carried out without such local professional validation.

It is solely the customer's responsibility to ensure compliance with all local regulations and authority requirements prior to construction.

All files are provided "as is" and "as available", without any guarantees of fitness for a particular purpose.

SECTION 5A - BUDGETING TOOL AND BUDGET SHARING

The Services include an online budgeting tool (the "Budgeting Tool") that allows users to create, store, and optionally share material and execution budgets with other users of the Services ("Shared Budgets"). The following terms govern the use of the Budgeting Tool and any publication, distribution, or import of Shared Budgets.

Use of the Budgeting Tool

The Budgeting Tool is provided as a utility for internal cost estimation and project planning. All data entered into the Budgeting Tool, including but not limited to material prices, units, currencies, execution durations, worker counts, additional costs, notes, and hourly rates, is provided and maintained solely by the customer. LEVA does not verify, audit, or guarantee the accuracy, completeness, or applicability of any data entered into the Budgeting Tool. The customer remains solely responsible for the correctness and suitability of all entered data and for any decisions made on the basis of such data.

Indicative nature of all figures

Any price, rate, quantity, duration, subtotal, or total displayed anywhere in the Services, whether entered by the customer, imported from another user, derived from a catalogue, or calculated by the Services, is indicative and for orientation only. Such figures do not constitute a price quotation, a binding offer, an estimate within the meaning of any applicable construction or consumer legislation, or professional cost advice from LEVA. Catalogue or default values, where present, are illustrative placeholders and are not represented to reflect current market prices in any territory.

Publishing a Shared Budget

By electing to publish a budget through the Budgeting Tool, the customer authorizes LEVA to make a subset of the data entered into the Budgeting Tool (the "Public Payload") visible to other users of the Services. The Public Payload includes:

  • the customer's displayed name and country, as set in the sharing profile;
  • optional logo, social media links, and city information voluntarily added by the customer to the sharing profile;
  • all material prices, units, currencies, and related metadata stored in the customer's central budget;
  • all execution data, including duration, workers, notes, video tutorial links, additional costs, difficulty, and timeline, stored in the customer's central budget;
  • hourly rates by category.

The following information is never included in the Public Payload, regardless of sharing status, except as expressly stated below:

  • the customer's email address;
  • the customer's physical address or precise geographic location (only country-level information is shared);
  • any data not stored in the customer's central budget, including project-specific or private budgets.
Sharing Status Options

The customer may select one of the following sharing statuses at any time:

Public - the Public Payload is freely discoverable by all users of the Services and may be imported without restriction.

Behind Paywall - the existence and basic metadata of the budget (such as name, country, and item count) is discoverable, but importing the Public Payload requires that users visit an external link provided by the customer. The paywall link is the customer's sole responsibility. LEVA does not validate the paywall link, process any payments made through it, guarantee its availability or functionality, and bears no responsibility for any transaction conducted between users and the paywall destination.

On-Demand - the existence and basic metadata of the budget is discoverable, but its figures are withheld until the owner grants access. A user who wishes to see the budget submits an access request through the Services; the owner may approve the request for a limited period of their choosing, decline it, or leave it undecided. Approval grants time-limited access which lapses automatically on expiry and may be extended by the owner. In submitting a request, the requesting user discloses to the owner the identifying and contact details entered into the request form, and the owner's email address is made available to the requesting user for the purpose of that request. By selecting this status, the customer expressly consents to that disclosure and acknowledges that they may be contacted directly. This consent is recorded at the moment of status activation and remains effective until the customer changes the sharing status. The customer may withdraw this consent at any time by changing the sharing status or by declining or not renewing individual requests; previously disclosed email addresses and previously imported data, however, cannot be retrieved.

Private - the budget is not discoverable by other users. Only the customer can access the budget.

Access controls, approval states, and expiry periods are technical conveniences operated on a best-efforts basis. LEVA does not warrant that they are proof against circumvention and bears no liability for access obtained contrary to a customer's intended sharing status.

Real-time Actualisation

The Budgeting Tool offers a real-time actualisation option. When enabled, the Public Payload is automatically updated to reflect the customer's most recent budget data; new users importing the budget always receive the most recent values. When disabled, the Public Payload represents a snapshot taken at the moment of the customer's last manual publication. In either case, users who have already imported the budget retain their imported version and must re-import the budget to receive any subsequent updates. LEVA has no ability to push updates to previously imported budgets or to retrieve copies held by other users.

Redistribution of Imported Data

Where a customer imports a Shared Budget from another user and subsequently publishes their own Shared Budget, records originally imported from a Public source may be redistributed as part of the customer's own Public Payload. Records imported from a Behind Paywall or On-Demand source are automatically excluded from the customer's Public Payload and will not be redistributed. If the customer manually edits an imported record, the record is treated as the customer's own data and may be redistributed regardless of the original source's sharing status.

Changes and Removal

The customer may modify, change the sharing status of, or set to Private any Shared Budget at any time. Changes to sharing status apply immediately to new imports. Copies of the Public Payload previously imported by other users are not affected by such changes and LEVA has no ability to retrieve, modify, or delete them.

No Warranty on Shared Budgets

All Shared Budgets are provided "as is" and "as available" by the user who published them. LEVA does not verify, endorse, or guarantee the accuracy, completeness, currency, legality, or applicability of any Shared Budget to a customer's specific project, jurisdiction, or use case. The customer is solely responsible for reviewing and adapting any imported data to their own circumstances and bears all risk associated with reliance on Shared Budgets.

Acceptable Use

The customer agrees not to publish any Shared Budget that contains fraudulent or knowingly misleading information, infringes any intellectual property rights, contains personal data of third parties without lawful basis, violates any applicable law, or is otherwise inappropriate. LEVA reserves the right, at its sole discretion, to remove any Shared Budget that it believes violates these Terms or applicable law, without prior notice and without liability.

Intellectual Property in Shared Budgets

Customers retain ownership of the data they enter into the Budgeting Tool. By publishing a Shared Budget, the customer grants LEVA and other users of the Services a non-exclusive, royalty-free, worldwide license to host, display, distribute, and (in the case of other users) import the Public Payload solely for the purposes contemplated by the Services. This license remains in effect for any copies imported by other users prior to a change in sharing status.

Limitation of Liability

LEVA's liability with respect to the Budgeting Tool and any Shared Budget is subject to and limited by Section 15 (Disclaimer of Warranties) and Section 16 (Limitation of Liability) of these Terms. In particular, LEVA shall bear no responsibility for any inaccuracies in Shared Budgets, any loss arising from reliance on imported data, any transactions conducted through paywall links, or any communications between users following an On-Demand request.

SECTION 5B - PRICE REQUESTS, QUOTES AND DEALINGS BETWEEN USERS
What the Services do and do not do

The Services include features that allow one user (the "Requesting User") to send a request for prices in respect of a configured project to one or more other users (each a "Responding User"), and allow a Responding User to return priced data in reply (a "Quote"), together with related access requests, approvals, notifications, and messaging conveniences (collectively, the "Marketplace Features").

The Marketplace Features exist to make information in construction easier to reach and faster to compare: to let a project be described precisely, to let figures be exchanged without re-keying, and to shorten the distance between a question and an answer. They are a communication and calculation utility and nothing more.

LEVA is not a party to any dealing between users. LEVA is not a contractor, subcontractor, supplier, broker, agent, intermediary, representative, escrow, guarantor, quantity surveyor, cost consultant, or professional adviser of or for any user, and does not act on behalf of either side. No agency, partnership, joint venture, employment, or fiduciary relationship arises between LEVA and any user by reason of the Marketplace Features.

No guarantee of prices or figures

All prices, hourly rates, coefficients, quantities, durations, worker counts, subtotals, totals, validity periods, and any other figures communicated through the Marketplace Features originate exclusively from the users who entered them. LEVA does not set, review, verify, audit, approve, benchmark, correct, or guarantee any of them.

In particular, and without limitation, LEVA does not guarantee or represent:

  • that any material price, hourly rate, or total reflects prevailing market prices in any territory or at any time;
  • that a Quote is complete, that it covers the whole of a project, or that the scope a Responding User has priced matches the scope the Requesting User intended;
  • that quantities, dimensions, durations, or other quantities derived from a configured model correspond to what a given project will actually require on site;
  • that a Responding User holds the qualifications, licences, insurance, capacity, or availability to perform any work;
  • that a Responding User will honour a Quote, or that a Requesting User will proceed with, pay for, or continue any dealing;
  • that the parties will reach agreement at all, or on the figures displayed.
Quotes are non-binding and incomplete by design

A Quote submitted through the Services is an indicative, non-binding indication of price. It is not an offer capable of acceptance, and no contract between users is formed by sending, receiving, viewing, opening, importing, or acting upon a Quote within the Services. The Services provide no mechanism for accepting, confirming, or concluding a Quote, and any acceptance, order, contract, or commitment between users must be concluded separately and outside the Services.

A Responding User selects which parts of a project their Quote covers. A Quote therefore ordinarily covers only part of a project, and the remainder is not priced, not offered, and not to be inferred. A Requesting User must not assume that anything absent from a Quote is included, free of charge, or agreed.

Figures shown in a Quote are calculated against the configuration of the project as it stood at the time the Quote was prepared. Where the Requesting User subsequently alters the project, the figures may no longer correspond to it. Any validity period stated in a Quote is set by the Responding User and is a statement by that user alone; LEVA neither enforces nor guarantees it.

Responsibility of the parties

Each user is solely responsible for the content, accuracy, lawfulness, and completeness of everything they submit through the Marketplace Features, including the description of a project, the identifying and contact details they supply, and every figure in a Quote. Each user is solely responsible for verifying the identity, standing, qualifications, and suitability of the other party before entering into any dealing, and for satisfying themselves as to the adequacy of any price before relying on it.

Any contract, order, deposit, payment, performance, delivery, warranty, defect, delay, damage, or dispute arising between users is exclusively a matter between those users. LEVA is not responsible for, and has no obligation to mediate, arbitrate, adjudicate, enforce, refund, compensate, or otherwise become involved in any such matter, and disclaims all liability arising from it to the maximum extent permitted by law.

Communications and delivery

Notifications, email messages, and links generated by the Marketplace Features are provided on a best-efforts basis. LEVA does not guarantee that any request, quote, approval, or notification will be delivered, delivered promptly, seen, or acted upon, and bears no liability for any consequence of a communication that is delayed, undelivered, misdirected, filtered, or ignored.

Data disclosed between users

By sending a price request, a user discloses to each recipient the details entered into the request form, including their name, email address, telephone number, place of realisation, description, and a link to the configured project. By submitting a Quote, a Responding User discloses to the Requesting User the details entered into the quote form, including their name, telephone number where provided, and the priced data they have selected to include.

Users must not submit personal data of third parties without a lawful basis, and must use data received through the Marketplace Features solely for the purpose of the dealing in question. Data received from another user must not be published, resold, redistributed, or used for unsolicited marketing.

Acceptable use of the Marketplace Features

Users must not use the Marketplace Features to send fraudulent, misleading, abusive, or spam communications, to solicit users for purposes unrelated to a genuine project, to harvest contact details, to misrepresent their identity, qualifications, or authority, or to circumvent access controls placed on another user's data. LEVA may, at its sole discretion and without prior notice or liability, remove content, withdraw access to the Marketplace Features, or suspend an account it believes to be in breach.

Limitation of liability

LEVA's liability with respect to the Marketplace Features is subject to and limited by Section 15 (Disclaimer of Warranties) and Section 16 (Limitation of Liability). Nothing in this Section limits any liability which cannot be limited under mandatory applicable law, including mandatory consumer protection law.

SECTION 6 - INTELLECTUAL PROPERTY AND LICENSE

All products and content provided through the Services are the exclusive intellectual property of THE s.r.o. or its licensors.

Upon purchase, you are granted a non-exclusive, non-transferable, non-sublicensable license to use the purchased products for your own or your client's projects.

You may not resell, distribute, sublicense, share, or otherwise make the products available to third parties as standalone files or competing products.

All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may include tools or integrations provided by third parties. These are provided "as is" without warranties or endorsements. LEVA bears no responsibility for third-party tools or services.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links to third-party websites. LEVA is not responsible for the content, accuracy, or practices of third-party sites, and access to them is at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

LEVA is powered by Shopify; however, all sales and transactions are conducted solely between you and LEVA. Shopify bears no responsibility for products or services sold by LEVA.

SECTION 10 - PRIVACY POLICY

All personal data is processed in accordance with our Privacy Policy and Shopify's Privacy Policy. By using the Services, you acknowledge and agree to such processing.

SECTION 11 - FEEDBACK

Any feedback, suggestions, or content you submit may be used by LEVA without restriction, compensation, or obligation.

SECTION 12 - ERRORS AND OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions and to update information or cancel orders if necessary.

SECTION 13 - PROHIBITED USES

You may not use the Services for unlawful purposes, to infringe intellectual property rights, or to interfere with the operation or security of the Services.

SECTION 14 - TERMINATION

We may suspend or terminate your access to the Services at any time for violation of these Terms. Provisions that by their nature should survive termination shall remain in effect.

SECTION 15 - DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services and all products are provided without warranties of any kind, whether express or implied.

Without limiting the foregoing, LEVA gives no warranty as to any figure, price, rate, quantity, duration, or total displayed, exchanged, or calculated through the Budgeting Tool or the Marketplace Features, nor as to the conduct, standing, or performance of any user of the Services.

SECTION 16 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, LEVA shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Services or products.

Without limiting the foregoing, and to the maximum extent permitted by law, LEVA shall not be liable for any loss, cost, overrun, underestimate, lost profit, lost opportunity, delay, or damage arising out of or in connection with reliance on any figure exchanged through the Budgeting Tool or the Marketplace Features, or arising out of or in connection with any dealing, contract, or dispute between users.

SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold harmless LEVA from any claims arising from your breach of these Terms or misuse of the Services, including any claim brought by another user in connection with a Shared Budget you published, a price request you sent, or a Quote you submitted.

SECTION 18 - SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 19 - ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and LEVA regarding the Services. They do not govern, and are not incorporated into, any contract concluded between users.

SECTION 20 - ASSIGNMENT

You may not assign your rights or obligations under these Terms without prior written consent. LEVA may assign these Terms freely.

SECTION 21 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic, unless mandatory consumer protection laws provide otherwise.

SECTION 22 - CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
